While many cities are using red light cameras to ticket drivers who are caught running red lights, this trend in enforcing traffic laws has just hit a significant speed bump in St. Louis. On Tuesday November 5, the Missouri Court of Appeals struck down an ordinance that had permitted red light cameras to be installed and operated at certain signals in Ellisville. This ruling was part of the Court’s review of a class action lawsuit that had been filed against Ellisville and American Traffic Solutions, the company responsible for providing the cameras used at Ellisville intersections.
According to the class action lawsuit, the plaintiffs had contended that the red light ordinance was in violation of Missouri state laws because traffic tickets were being doled out to the wrong parties – namely, the owner of the cars, instead of the drivers who had allegedly ran the red lights, were being ticketed. The Court’s agreement with the plaintiff’s arguments led to the red light ordinance been declared void.
While the long-term effects of the Court’s decision have yet to be felt by drivers in St. Louis, individuals who have received tickets from red light cameras will now be able to contest these tickets and will more than likely be able to have them dismissed in traffic court.
