Suffering a personal injury can have devastating impacts on your mental and physical health, and getting the treatment that you need will be critical to your recovery and future. By filing a personal injury lawsuit, you can rest assured that you will likely obtain the compensation you need and deserve so that you can focus on getting better and moving on with your life. The following personal injury FAQs can provide you with more insight as to how personal injury claims typically proceed and what you can, in general, expect from these cases.

How do I know if I have a case?

While, for some cases like car accidents, it may be very clear who is at fault and when that other party is negligent (say, for example, because another driver was drunk and caused the accident), in many cases, it will not be so apparent who may have been to blame for the accident and your injuries. This is why it’s very important that, after sustaining an injury, you consult with an experienced lawyer who can thoroughly evaluate your case and determine:

  • Who was likely at fault for the accident and injuries
  • Whether negligence or recklessness played a role in causing the accident and resulting injuries
  • Whether you are entitled to compensation for your injuries.

What is negligence?

Negligence occurs when some person or entity fails to act with the proper care and, as a result, puts others at risk of being injured. This failure to behave as any other reasonable person would under similar circumstances is grounds for filing a personal injury lawsuit against the negligent party and obtaining compensation for any injuries incurred as a result of said negligence.
